Design registration protects the visual appearance of a product or system. It does not protect the material used or how the product works.
If the work is created within the scope of employment, the employer owns the rights. If the creator is an independent contractor, the rights remain with them unless there is an agreement stating otherwise.

Design registration is especially important when the shape or appearance of a product influences customer preference. Even when a design is protected, some uses may still be lawful, but permission is required in many cases. Credit, lack of monetization, or copying from other sources does not automatically prevent infringement.
Submit the endorsed application form (Form 15) to the Patent Office with your name, contact details, design structure, and supporting photos. You may also provide a written description or Statement of Novelty. The application should describe the design’s appearance, not the product’s materials.

You can file directly or use an IP agent. An agent may require a power of attorney.
The Patent Office checks the application for compliance with the rules and issues an application number within 30 days.
After formal examination, the Patent Office conducts a substantive assessment, usually within six months. The results are sent to the applicant or agent, and any objections must be addressed.
Once all objections are resolved, the design is registered and entered into the Register of Designs. A registration certificate is issued.
