The application is completed using IPO forms such as TM-1 or TM-2, depending on the type of goods or services. You must provide a description of the mark and list the relevant product or service classes.
The trademark registry reviews the application for completeness and may require corrections within 30 days if issues are found.
The IPO examines the application and publishes the mark in the Trademark Journal, checking for identical or confusingly similar marks.
Once accepted, the mark is advertised in the trademark journal. Oppositions may be filed during a four-month period, after which any opposition must be handled by your attorney.
If there is no successful opposition, a fee demand notice is issued. Upon payment, the IPO registers the mark and proceeds toward issuance of the certificate.
The registration certificate is issued after payment, and the ® symbol may be used to show the mark is registered.
Registered trademarks must be renewed every 10 years to maintain protection.
Trademark rights are not automatic forever. Owners must enforce their marks and stop misuse to avoid dilution or genericide, where a brand name becomes generic.
